Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Stealth Health Kitchen mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Stealth Health Kitchen (“we,” “us,” “our,” or “SHK”).
We reserve the right to update these Terms at any time. Material changes will be communicated via in-app notification or email. Your continued use of the App following such notice constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement. The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

SHK is a wellness and recipe application that provides:

  • A library of recipes across multiple subscription tiers.
  • Meal logging and macro/calorie tracking tools.
  • A Weight Loss Mode with personalized guidance based on user-provided health metrics.
  • Integration with Instacart for ingredient shopping (via affiliate links).
  • Push notifications, content updates, and in-app announcements.

4. Subscriptions and Billing

4.1 Subscription Tiers

SHK offers subscription-based access to premium features. Subscription tiers and their included features are described within the App and on our website at stealthhealthkitchen.com.

4.2 In-App Purchases

All subscriptions are processed through Apple App Store In-App Purchase (iOS) or Google Play Billing (Android). By purchasing a subscription, you also agree to the payment terms of the applicable platform:

We do not collect, store, or process your payment card information. All billing is handled directly by Apple or Google.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period. Refunds are governed exclusively by Apple’s or Google’s refund policies, as applicable. We do not issue refunds directly.

4.4 Free Trials

Specifically:

  • Calorie and macronutrient information is derived from the USDA FoodData Central database and is provided for informational purposes only. Nutritional values are estimates and may vary.
  • Weight Loss Mode collects certain health metrics (including gender/sex, weight, height, age, and activity level) to provide personalized guidance. This guidance is general in nature and does not constitute individualized medical advice.
  • Always consult a qualified healthcare professional before starting any diet, nutrition, or fitness program — especially if you have a pre-existing medical condition, are pregnant or nursing, or are under the care of a physician.
  • SHK is not regulated by the U.S. Food and Drug Administration (FDA) as a medical device.
  • We expressly disclaim any liability arising from your reliance on nutrition data, calorie tracking, or wellness guidance provided through the App.

5. Health and Wellness Disclaimer

IMPORTANT: SHK is a consumer wellness and recipe application. It is NOT a medical device, a licensed dietitian service, or a substitute for professional medical advice, diagnosis, or treatment.

Specifically:

  • Calorie and macronutrient information is derived from the USDA FoodData Central database and is provided for informational purposes only. Nutritional values are estimates and may vary.
  • Weight Loss Mode collects certain health metrics (including gender/sex, weight, height, age, and activity level) to provide personalized guidance. This guidance is general in nature and does not constitute individualized medical advice.

6. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that contain false or misleading information.
You may delete your account at any time through the App settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, subject to applicable retention obligations.

7. Intellectual Property

All content within the App — including but not limited to recipes, meal plans, photographs, text, graphics, logos, video content, and the SHK brand and likeness — is owned by or licensed to Stealth Health Kitchen and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non commercial purposes only. You may not:

  • Copy, reproduce, distribute, or publicly display any App content without prior written
    consent
  • Scrape, crawl, or use automated means to extract recipe data
  • Reverse engineer, decompile, or disassemble any portion of the App
  • Use any content for commercial purposes without express written permission

8. Third-Party Services

8.1 Instacart

The App includes affiliate links to Instacart, a third-party grocery delivery platform. When you tap a shopping link, you will be redirected to Instacart’s platform. Your use of Instacart is governed by Instacart’s own Terms of Service and Privacy Policy. We earn a commission on qualifying purchases made through these links. We are not responsible for the availability, pricing, or fulfillment of any products on Instacart.

8.2 Apple Health and Wearable Integration

Future versions of the App may integrate with Apple HealthKit and Apple Watch. Such integrations will require your explicit opt-in consent. Health data accessed through HealthKit will not be used for advertising or shared with third parties for marketing purposes, in compliance with Apple’s HealthKit guidelines.

8.3 Other Services

The App may link to or integrate with other third-party services. We are not responsible for the content, privacy practices, or terms of any third-party service.

9. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any portion of the App or its related systems.
  • Interfere with or disrupt the integrity or performance of the App.
  • Upload or transmit any malicious code, virus, or harmful content.
  • Impersonate any person or entity.
  • Harvest or collect personal information about other users.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SHK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED
TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.
In no event shall our total liability to you for all claims arising out of or relating to your use of the App exceed the total amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SHK, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App will immediately cease. Sections 5, 7, 10, 11, 12, and 14 shall survive termination of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Dallas, Texas, and you consent to personal jurisdiction in such courts.
WAIVER OF CLASS ACTION: TO THE EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
